Pre-Conference Institute: Financial and Tax Matters in Divorce – Practical Strategies

These workshops will, through sample case studies and illustrative examples, provide practitioners with practical tools for identifying, analyzing, clarifying and resolving critical financial and tax issues in divorce, helping them and the attorneys or mediators and the divorcing parties they represent make smart, practical and informed decisions.

Workshop I: Strategies and Tools for Handling Fundamental Financial and Tax Matters in Divorce

This workshop addresses such topics as financial and tax projections; combining income, budgeting, real estate, child support, taxes, and alimony to achieve an overall result that recognizes the financial resources and responsibilities of both parties; tools and techniques that enable the parties to reach agreement with respect to division of property; and practical techniques for efficiently reaching an outcome that is fair, workable and acceptable to both parties.

Workshop II: Advanced Topics

This workshop, a continuation of Workshop I, addresses topics such as determining which filing status is best, whether the parties should file jointly or separately, whether they should divorce this year or next, who should claim the exemptions; complex real estate issues associated with the marital residence and investment properties, including refinancing, and tools and techniques that enable the parties to reach agreement regarding the division of property, including separate property and discretionary expenses.

There will be a 10 minute break between Workshops I and II.

A Guide to IRC §1031 Tax Deferred Exchanges

This seminar is designed to teach both inexperienced and experienced practitioners how to successfully navigate §1031. The 1031 Exchange concept could be a valuable strategy for any investor or advisor when considering the disposition of real estate that was either held as part of a trade or business or for investment purposes. Under IRC §1031, a taxpayer can defer the capital gain taxes and the depreciation recapture taxes that would be due upon the sale of a property as long as they follow the guidelines of the code section and reinvest the proceeds into a qualified replacement property(s) within the imposed deadlines. Attendees will learn how to best structure real estate deals to maximize §1031’s benefits and to avoid its pitfalls. Attendees will also discover the wide range of replacement property options available in today’s market. Each attorney and CPA in attendance will be provided with additional continuing education credits through self study courses. Attorneys will receive 2.5 elective credits, and CPAs will receive 2 elective credits.
